As a
subscriber to Local Online you agree to the following terms and conditions. Local
Online may modify these terms and conditions at any time, and such modifications
shall be effective immediately upon posting. Your continued use of the Service
shall be construed as your acceptance of the updated Agreement.
Services
- Local Online will provide dial-up access to the Internet,
an e-mail account, and software for IBM Win95 compatible systems. The customer
will provide the computer, the modem, and the phone connection.
- Unlimited
Dial-up Access is defined as an on-demand, temporary connection to the Internet.
Using artificial means to maintain a continuous connection while away from your
computer is not permitted. Local Online has the right to terminate any connection
lasting more than 12 consecutive hours. Any violations will lead to a suspension
of the service.
- Local Online does not allow
concurrent usage (making 2 or more simultaneous connections with the same username/password).
- Local Online does not restrict personal e-mail.
However, spamming (the act of sending unsolicited e-mail) is strictly prohibited.
If a person is suspected of spamming, their account will be immediately deactivated.
Local Online will only reactivate the account after a discussion with the offending
party. If it is confirmed that a party has violated the Local Online spamming
policy we reserve the right to permanently terminate the account with no refund
and issue a $200.00 fine with additional charges of $50 per complaint received.
- Local Online will make every effort to notify
all of our customers for any scheduled downtime. There may be a few rare exceptions
when Local Online will not be able to notify you of downtime due to circumstances
beyond Local Online's control.
- Local Online
is not responsible for any material that is posted to a web page or that is available
on the Internet. Local Online will work with law enforcement officials and will
release information that is necessary for any investigations. Local Online reserves
the right to suspend home page(s) and/or account(s) that distribute material(s)
in violation with the law. If abuses occur, Local Online will promptly notify
the subscriber(s). Upon notification, immediate corrective action should be taken
by the subscriber(s) or Local Online will suspend the account(s). The party(s)
involved are responsible for charges that accrue while the account is suspended.
- Local
Online's free technical support extends to configuring and maintaining Internet
access and e-mail accounts. Issues resulting from web-site specific applications
or configuring hardware may not be supported.
Each
of us agrees that:
- Unless otherwise
provided for in this Agreement, either party may terminate this Agreement, with
or without cause, by giving notice to the other.
- Person(s)
applying for service must be 18 years of age or older. Minors can be authorized
to use this service with the consent of an adult. It is the adult's responsibility
to ensure that the bill is paid in a timely manner.
Your
Responsibilities:
- To keep current all
registration information -- including your address, phone number and billing information.
- Not
to assign, or otherwise transfer, this Agreement or your rights under it, delegate
your obligations, or resell the Service.
- Not
to introduce viruses, worms, harmful code and/or trojan horses on the Internet.
- To keep your password confidential. If you
suspect unauthorized use of the Service, notify Local Online immediately. Until
then, you remain responsible for unauthorized use.
Billing
- Credit cards will be billed at the beginning of each
month with a summary of charges sent via U.S. Mail. The first charge will occur
immediately after sign-up.
- Check or money order
clients will be sent an invoice at the beginning of each month for that month’s
service. A returned check charge of $25.00 will be incurred for all returned checks/electronic
transfers.
- $25.00 Set up fee will be waived on all "paid" prepaid agreements.
- All discount rates are subject to
pre-paid accounts. There are no refunds on 6-month or 1-year service agreements.
- Charges
incurred due to additional usage or services will be billed with the next month's
fee.
- Local Online reserves the right to suspend
accounts if payment has not been received by the first of the month, or if a credit
card has expired or been declined.
All billing
disputes, with Local Online, must be received at our business office in writing,
and the obligation to pay for service will continue until such notice is received.
Termination of your service does not constitute relief from charges incurred prior
to termination.
YOUR ACTION IS REQUIRED TO CANCEL DIAL-UP
INTERNET SERVICE. Cancellation may be submitted by phoning the Local Online at
(810) 748-9010. Upon cancellation, accounts will be terminated -- money will not
be refunded for a partial month. There is a $10.00 fee to re-activate the account.
